This is an application for condonation of delay in filing restoration application.

Learned counsel for the applicant submits that the counsel who had filed the petition initially had expired and thereafter the matter was allotted to Advocate from the Panel of Legal Aid Committee, however, no steps were taken for removing the office objections and resultantly the registration of the petition came to be refused by order dated 28th March, 2022. Mr. Omkar Deshpande, learned counsel submits that thereafter the matter is allotted to him through Legal Aid Committee and now he wants to take steps for restoration of
6-cao786.24.odt 2/3 the matter by removing office objections. He submits that in this process the delay of 764 days occurred and the same is unintentional.

Having regard to the contentions of the civil application and the submissions advanced, particularly the fact that the petitioner is appointed from legal aid panel, the delay needs to be condoned.

In view of above submissions, the civil application is allowed.

The delay of 764 days is condoned.

The application is disposed of.

This is an application for restoration of the writ petition, which was dismissed for failure to remove the office objections.

Counsel for petitioner submits that he is now ready to remove the office objections so that the matter could be decided on merit.

Having regard to the contents of the civil application and the submissions advanced, the application is allowed. 4.
Writ Petition is restored to its original number.
