This application is filed by the applicant under Section 5 of the Limitation Act for condonation of delay of 1742 days caused for filing application for restoration of First Appeal which was dismissed for non filing of private paper book within time prescribed by the court.

Perused the application. Heard the learned Advocates for both the sides.

Considering the reasons stated in the application, the application deserves to be allowed in the interest of justice, as the delay is not deliberately caused. The application is allowed and disposed.

Learned Advocate for the applicant submits that the paper book is ready and will be filed on or before 24.10.2024. If the paper book is not filed on or before 24.10.2024, this application shall be deemed to be dismissed without further reference to the court.
