This is an application for condonation of delay in filing an application for restoration of the first appeal, of which registration was refused for failure to remove office objections.

Learned counsel for the applicant/appellant submits that the delay of 372 days occurred since, the applicant was not aware about the order of refusal of registration.

It is submitted that the applicant/appellant desires to contest the appeal on merits and seek restoration therefore, in the interest of justice, the delay deserves to be condoned.

In response to the notice, Advocate Mr. Agrawal appears on behalf of respondent No.1 and opposed the application.

Having regard to the contents of the application and submissions advanced, the delay of 372 days is condoned subject to cost of Rs.3,000/- (Rupees Three Thousand Only), to be deposited by the appellant within a period of two weeks' from today in the 'Public Welfare Account', which is directed to be opened by an Order dated 12.01.2026, passed by the Hon'ble Division Bench of this Court in Suo Moto Public Interest Litigation (SMPIL) No.01/2021, the details of which can be obtained from the Registrar (Judicial), Nagpur Bench, Nagpur.

In view of above, the civil application is allowed and disposed of.
M.C.A (ST.) NO.17619 OF 2024 IN FIRST APPEAL (ST.) NO.5793 OF 2023(D) 7.
By this application, the applicant seeks restoration of first appeal of which registration was refused for failure to remove office objections by an Order dated 08.08.2023. 8.
It is submitted that the appellant desires to contest the appeal on merits and therefore, seeks restoration of the first appeal.

For the reasons mentioned in the application and submissions advanced, the civil application is allowed and disposed of. The appellant is directed to remove office objections within a period of two weeks' from today. After objections are removed, appeal be restored.
