By this application, applicant is seeking condonation of 1962 days in filing restoration application. 2.

The learned counsel for the respondents vehemently opposed the application by stating that after dismissal of the appeal for not filing the private paper book, the application was moved to withdraw 50% of amount lying to the registry of this court. At that time, no objection was raised by the appellant in the matter.

It is further stated that for remaining amount the execution proceeding was filed before the Executing Court at Wardha. In the execution proceeding, the appellant states that as the appeal is dismissed, they are ready to deposit the entire amount. Accordingly, the entire decreetal amount is deposited in execution proceeding. As such judgment and award of Reference Court is satisfied in the matter.

In the circumstances, the learned counsel for appellant to take instructions from the appellant as to whether they want to prosecute the present appeal or not. 5.
