This is an application for condonation of delay in filing the restoration application in the First Appeal. 2.

The conditional order was passed for filing the paper book. The appellant was under the impression that the paper book is dispensed with. He was not aware about the dismissal of the First Appeal. Hence, there is delay of 116 days in filing the restoration application in the First Appeal.

Considering the reasons stated in the application, the same is allowed and the delay of 116 days is hereby condoned, subject to the costs of Rs.1000/- to be paid to the High Court Legal Aid Services Sub Committee, Nagpur within a period of two weeks Kavita
