Heard Ms. Shaista Pathan, learned Counsel appearing for the Applicant and Mr. Prasad Dhakephalkar, learned Senior Counsel appearing for the Respondent.

In the Interim Application No.198 of 2025, the relief sought is to allow deposit of the arrears of Rs.5,40,000/- calculated upto 31st December 2024.

Mr. Dhakephalkar, learned Senior Counsel appearing for the Respondent, states that without prejudice to the rights and contentions of the Respondent, the said prayer be allowed. Learned Senior Counsel further states that there are arrears even after 31st December 2024 till date.

Ms. Pathan, learned Counsel appearing for the Applicant, states that the said amount of Rs.5,40,000/- as also the arrears upto 30th November 2025, will be deposited within a period of four weeks. 5.

It is clarified that such deposit shall be without prejudice to the rights and contentions of both parties.

Accordingly, Interim Application No.198 of 2025 is disposed of. 7.

Place the Civil Revision Application on board on 12th January 2026.

Till next date, the eviction Order shall not be implemented, on the condition that the amount as directed to be deposited above will be deposited on or before 6th January 2026 and the Applicant shall deposit per month compensation on or before 10th day of each month. 9.

It is further directed that the Applicant shall not create any third party right, title and interest in respect of the suit premises. [MADHAV J. JAMDAR, J.]
