The paragraph No. 17 of the affidavit dated 23/09/2024 sworn by Shri. Tushar Mahajan, Deputy Secretary,
School Education and Sports Department, State Government reads thus :
"17. With reference to the contents of para Nos. 26 and 27 of the affidavit dated 07/08/2024 of the Petitioner, I say that, the Committee formed by the Government has conducted meeting on 21/08/2024 and 29/08/2024. I say that, the Committee report is at final stage and likely to submit its report at the earliest. I say that, the State Government is trying its level best to discharge its obligations under the RTE Act. I deny all the allegations made by the Petitioners."

The lethargic approach on the part of the State Government particularly with the School Education Department can be noticed from the fact that but for the meetings being held in the month of August, 2024, nothing positive is placed on record thereby indicating any decision if taken so as to resolve the issue which is sought to be canvassed through Writ Petition.

A meagre remuneration of Rs. 7000/- is being offered which is even less than the salary paid to the peon of the State Government. In this background if the decision taken by the committee and further progress is not place on record within a period of four weeks as has been prayed by the Assistant Government Pleader, we direct the Additional Chief Secretary, Department of School Education to remain
present before this Court on 20th February, 2025 so as to enable this Court to frame the charge under the Contempt of Court Act, 1971 against the said Officer. The matter be listed in the urgent admissions category, on the supplementary board.
