The above Interim Application is filed seeking a condonation of delay of 365 days to recall the order dated 21st December 2022 passed by this Court. By the said order, the Appeal was dismissed by this Court. 2.
The learned Advocate appearing on behalf of the Respondent-wife March 08, 2024 Shraddha Talekar, PS
15-IA-1337-2024-FCA-107-19.doc submitted that as on date, an amount of Rs.8,15,000/- is outstanding as due and payable towards arrears of maintenance. The learned Advocate appearing on behalf of the Applicant-husband, on taking instructions over the telephone, submitted that this amount of Rs.8,15,000/- would be paid to the Respondent-wife in the following manner : (a) Rs.3,00,000/- will be paid on or before 12th March 2024; and (b) The remaining amount of Rs.5,15,000/- will be paid on or before 3rd May 2024.

We accept the said statement as an undertaking given to this Court. We make is clear that the if the aforesaid amount is not paid within the periods stipulated above, the above Interim Application shall stand dismissed without further reference to this Court. 4.
We place the above Interim Application on Board on 3rd May 2024. 5.
