Interim Application has been preferred seeking condonation of delay of 12 days caused in filing First Appeal. 2.

Learned Counsel appearing for the Appellant submits that Appellants are residents of Surat, Gujarat and the proceedings were initiated in Mumbai and by reason thereof, after the impugned judgment was passed, certain time was consumed in engaging an Advocate in Mumbai for the purpose of filing Appeal resulting in delay of 12 days.

Learned Counsel appearing for the Respondent submits that there is no sufficient explanation for the delay. 4.

In the present case, delay is of 12 days and is sufficiently Patil-SR 1 of
