Interim Application has been preferred seeking amendment by enhancing the compensation claimed.

Learned counsel for the Appellant sumits that after the decision of the Reference Court, the Respondents had not deposited the compensation in time and due to want of funds, the Applicants were unable to arrange for the Court fees and therefore restricted their claim to Rs.14,000/- and paid Court fees of Rs.1000/- only. He further submits that after the deposit of the compensation amount, the funds could be arranged and therefore the present application is filed seeking enhancement.

Mr. Patil, learned AGP does not seriously oppose the application. 4.
Amendment is sought for enhancing the claim amount and permission to pay additional Court fees on the enhanced amount. The specific pleading is that due to financial constraints, the claim was restricted to only Rs.14,000/- and it is only after the compensation amount was permitted to be withdrawn, the funds were made available and the Applicants were in a position to pay Court fees on the enhanced claim.
