Interim Application has been preferred for bringing on record the legal heirs of the deceased Appellant No. 1 on record and for condonation of delay of 2 years and 356 days caused in preferring the Application.

Learned Counsel appearing for the Applicant submits that the Appeal is of the year 2011 and during the pendency of the proceedings the Appellant No. 1 expired and the legal heirs were not aware of the procedure that they have brought on record in place of the Appellant No. 1 and it is only in October-2024 that they contacted the Advocate on record and informed him about the death of the Appellant No. 1. He submits that there is sufficient explanation for the Shubham Talle 1 of

Learned AGP does not seriously oppose the Application, considering that the proceeding arise out of the Land Acquisition proceedings.

For the reasons stated in the Application and as submitted by learned Counsel appearing for the Applicant there is sufficient explanation for delay and the same stands condoned. 5.
