This interim application is filed praying for restoration of Interim Application No.12757 of 2023 praying for condonation of delay which came to be rejected for want of prosecution vide an order dated 25 January 2024 passed by a co-ordinate Bench of this Court.

We have perused the averments as made in the application. In our opinion, it is in the interest of justice that the order dated 25 January 2024 needs to be recalled and the interim application for condonation of delay needs to be restored to the file of this Court, to be heard on merits. 3.

We may also observe that there is delay of 6 days in filing the interim application. Delay has been sufficiently explained and it needs to be condoned. The interim application is accordingly allowed in terms of prayer clauses (a) and (b).

Disposed of. No costs.
