DATE : 28 MARCH, 2024 P.C. :- After the matter was argued for some time, Mr. Daga, learned counsel for the applicant sought some time to take instructions from his client in order to deposit the amount in order to show his bona fide. After some time, when the matter was called out again, Mr. Daga submits that without prejudice to the rights and contentions, his client is ready to deposit a sum of Rs.15,00,000/- out of the total outstanding amount.

Ms. Khan, learned counsel appearing for the respondent wife submits that as of date, the outstanding amount is Rs.34,40,000/-. She submits that the respondent wife is suffering from serious illness 'Cancer'. She submits that the petitioner should be directed to deposit the entire amount of Rs.34,40,000/-. She submitted that from 11 June, 2019, the petitioner/husband has not paid any amount towards maintenance towards herself and the daughter. 3.
Mr.Daga submits that his client has complied with the directions as regards to the school fees/charges of the daughter. 4.
According to me, in the interest of justice, the petitioner is hereby directed to deposit a sum of Rs.15,00,000/- without prejudice to the rights and contentions in the bank account of the respondent within a period of two weeks from today. 5.
If such amount is not deposited in the bank account of the respondent within a period of two weeks, the writ petition to
3/3 stand dismissed without further reference to Court. 6.
Stand over to 18 April, 2024, High on Board.

In case the amount of Rs.15,00,000/- is deposited within a period of two weeks from today, there will be ad-interim relief in terms of prayer clause (b) till the next date of the hearing. [RAJESH S. PATIL, J.]
