The prayer in the Interim Application is to amend the Writ Petition in accordance with Schedule at Exhibit-A. It is an admitted position that the Writ Petition is not yet admitted. By the proposed amendment, order passed below Exhibit-11 in Petition No.A-2200 of 2020 is being challenged. In the Writ Petition challenge is to the order dated 24th August 2023 passed below Exhibit-10 in Petition No.A-2200 of 2020 by the learned Family Court Mumbai at Bandra.

It is the submission of learned Counsel appearing for the Applicant i.e. original Petitioner that common order has been passed below Exhibits 10 and 11.

It is the submission of learned Counsel appearing for the Respondent that two separate Writ Petitions are required to be filed. However, as the said Applications bearing Exhibits 10 and 11 have been disposed of by the common order, there is no impediment in challenging the same in the same Writ Petition and therefore, in allowing the Interim Application. 4.
Accordingly, the Interim Application is allowed in terms of prayer clause (a). Amendment be carried out within a period of two weeks from today.

The Interim Application is disposed of in above terms with no order as to costs.

Stand over to 27th February 2025. To be listed fairly high on board.
