The above Interim Application is filed seeking a stay to the execution of the Judgment and Decree dated 23rd January, 2024 passed by the learned Family Court at Bandra, Mumbai in Petition A-1077/2021. By the impugned Judgment and Decree, a divorce is granted to the Respondenthusband. When the above matter had come up on 28th June 2024, the learned counsel appearing on behalf of the Respondent-husband sought time JULY 12, 2024 Aswale
17.ia.7475.24.doc to file an affidavit in reply and also stated that the Respondent has not remarried. We, therefore, adjourned the matter to enable the Respondenthusband to file his reply and also directed that he shall not remarry until further orders.
Today when the matter is called out, the learned counsel appearing on behalf of the Respondent-husband, on instructions, has stated that the Respondent-husband has no intention to remarry during the pendency of the above Appeal. Once this is the statement, we dispose of the above Interim Application by accepting the said statement as an undertaking given to the Court.
The above Interim Application is accordingly disposed of. However, there shall be no order as to costs. This order will be digitally signed by the Private Secretary/ Personal Assistant of this Court.
