Heard learned Advocate for the respective parties. 2) Present Application filed by the Original Claimants seeking withdrawal of the entire compensation amount deposited by the Appellant. 3) Mr. Mehta, learned Advocate for the Appellant opposed the Application.
4) Ms. Patki, learned Advocate for the Applicants/Claimants submitted that the Applicants were earlier allowed to withdraw 20% of the compensation amount vide Order dated 03rd April, 2019 in Civil Application No.1290 of 2019. However, a considerable period of time has 1/2
P.H. Jayani 10 fa284.2025.doc passed since then. She further states that the Applicants are in financial difficulty.
5) Therefore, and in view of the other grounds stated in the Application, the Applicant Nos.1 and 2 are permitted to withdraw further 30% of the compensation amount of their share with proportionate interest subject to furnishing usual undertaking that in case the Appellant succeeds in this Appeal, the Applicant Nos.1 and 2 would refund the said amount along with interest as would be directed by this Court. The Tribunal shall invest remaining amount of compensation with nationalized bank giving highest interest from time to time.
6) Interim Application stands disposed of.
ORDER IN FIRST APPEAL NO.284 OF 2025 :- 7) The learned Advocate for Respondent No.1 has filed compilation of documents. Hence, the learned Advocate for the parties submitted that the Appeal be taken up for final hearing on the next date in case the Respondent No.2 is served.
8) In view thereof, the compilation of documents is taken on record.
9) Registry to call for the Record and Proceedings from the concerned Tribunal as the Appeal is permitted to be taken up for final hearing at the stage of admission.
10) Stand over to 21st April, 2025.
