2) Present Application filed by the Original Claimants seeking condonation of 1 year and 64 days delay in filing the aforesaid Appeal. Respondent Nos.1 and 2 are duly served but none present for the said Respondents.

3) Mr. Nakhwa, learned Advocate for the Applicants states that due to financial difficulties and difficulty in obtaining relevant papers to file the Appeal, the Applicants could not file the Appeal on time. The Applicants have not taken any advantage of said delay. He submits that, the Applicants have good case on merits.

4) Considering the aforesaid submissions and the objects of law of compensation in accident cases, I am inclined to allow the Application. Hence the following Order.

ORDER

(a) Application is allowed.

(b) The 1 year and 64 days delay in filing the Appeal is condoned.

(c) Appeal be registered forthwith.

(d) Application stands disposed of.
