Pending the Appeal, Interim Application No. 8354 of 2024 is taken out by the wife, praying for grant of interim maintenance of Rs. 1 Lakh per month for herself and her daughter. 2.
We have heard the respective counsel in the background of the pleadings in the application, as well as the affidavits disclosing the assets and liabilities filed by both parties. The counsel for the applicant fairly concede to the fact that, under the proceedings under the Domestic Violence Act, the respondent husband is directed to make payment of Rs. 40,000/- per month.
2/3 10 IA 8354-24.doc On taking an overview of the earnings of the respondent husband and the requirements of the mother and daughter on monthly basis, we are of the view that if the husband has undertaken to cater to the educational expenses of the daughter aged 14 years, then, we suggested that some monthly expenses must also be paid towards maintenance of the daughter, as in growing age, apart from education, she require monies for other purposes also.
Upon this suggestion being made, the counsel for the respondent fairly conceded that he is ready to contribute a sum of Rs. 20,000/- per month towards maintenance of the daughter, which will be in addition to the maintenance of Rs. 40,000/- granted for the wife and daughter in the DV proceedings.

Since the wife is already getting maintenance through the DV proceedings, and now it is agreed that an additional amount of Rs. 20,000/- shall be contributed towards the maintenance of the daughter, we deem it appropriate to dispose of the application by accepting the aforesaid statement.
We would, however, make it clear that the respondent shall take care of the educational needs of the child, which shall include the necessary fees, conveyance, stationary, as well as other requirements. He has also undertaken before us that he will take care of her education.
In the wake of the aforesaid understanding reached between the parties and an undertaking submitted by the respondent that he will cater to the educational needs of the daughter, we dispose of the Interim Application No. 8354 of 2024.
