This application is for substituted service upon the respondent by way of publishing a notice in the local newspapers. Learned counsel for the applicant submits that the notice issued to the respondent is returned un-served with the remark 'not residing with the address and whereabout not known'. He therefore submits that even in the Family Court, the respondent was served by way of substituted service.

Hence, considering the aforesaid grounds that even in the VARSHA VIJAY RAJGURU Page no. 1 of 2

19-ia-9314-2024.doc Family Court, the respondent was served by way of substituted service in local newspapers, the petitioner is permitted to serve the respondent by substituted service.

The learned counsel for the applicant on instructions submits that the newspapers have wide circulation in the vicinity where the respondent is known to have last resided are "Maharashtra Times, Loksatta and Free Press Journal".

He therefore seeks permission to publish the notice in the aforesaid newspapers. The present application is allowed and the applicant is permitted to serve the respondent by substituted service by publishing the notice in Maharashtra Times, Loksatta and Free Press Journal. Necessary compliance to be made within two weeks and compliance report be submitted in the registry. 5.

Application is allowed in the aforesaid terms. 6.

List the Writ Petition on 5th July 2024.
