It is accepted even by the learned Counsel for Respondent Nos. 2 and 3 that transfer of the Petitioner and Mr. P.P.Waghmare is connected inasmuch as both of them are holding the same post. Because of this position, the Applicant has moved an interim

Trupti 2 910-wp-16756-2023.doc application for amendment to join Mr.Waghmare as a party Respondent.

Since the entire contention of the Applicant is that Mr.Waghmare was not liable to be transferred and the Applicant was moved to accommodate Mr.Waghmare, the presence of Mr.Waghmare will be necessary. Therefore, we grant leave to amend to join Mr.Waghmare, as prayed for in the interim application, as a party Respondent. Amendment as sought for in the interim application is allowed. Amendment to be carried out within four working days.

The Petitioner will give notice to the added Respondent and file affidavit of service.

Stand over to 4 July 2024.

The date of joining is extended to 8 July 2024. 7.
