The Interim Application seeks deletion of name of Respondent No.3 and for bringing his legal heirs on record. Heard the counsel for the Applicant and perused the application.

Since, according to us, the cause of action survives as against Respondent No.3 and impleadment of the legal heirs is necessary, the Interim Application is allowed in terms of prayer clause (b). 2.

Let the necessary amendment be carried out within a period of two weeks from today. Upon amendment being carried out, issue notice to the newly added respondent, making it returnable on 30/03/2026.

In addition to the Court notice, the notice is also permitted to be served through private mode of service.
