This is an application by Respondent in appeal (original Plaintiff) for expeditious hearing of the First Appeal. Record indicates that by the impugned Judgment and Decree, the Appellant was directed to pay Rs.5 lakhs along with interest. It is not disputed that the decreetal amount with interest has been deposited by the Appellant in this Court out of which the principal amount of Rs.5 lakh is already withdrawn by the present Applicant.

Learned Counsel for the Applicant submitted that mediation has failed and the Applicant is of advanced age of about 74 years as on date. He relies on certain medical documents annexed with the application.

In view of above, and considering the age of the Applicant and Sneha Chavan 1/2

10-IA-10386-2025.doc that the appeal is filed some time in 2018 and numbered in 2022, the application is allowed and the Appeal is directed to be added to the expeditious category / senior citizen category on the final hearing board as per its turn.
