1) Petitioners have challenged order dated 18 January 2023 passed by the Executing Court rejecting Petitioners' Applications at Exhibits-24 and 29. Passing of order dated 18 January 2023 has resulted in rejection of ad-interim injunction in favour of the Petitioners in 1 of
Renuka 9-IA-10591-2024 Special Civil Suit No. 1 of 2023. The order dated 18 January 2023 rejecting ad-interim injunction is subject matter of challenge in the Appeal.
2) As hearing of the Petition and the Appeal progressed, Mr. Butala the learned counsel appearing for the contesting Respondents fairly makes a statement that the Defendants in the suit are willing to make a statement not to withdraw the amounts currently lying in various bank accounts till the Trial Court decides the Application at Exh-5 for temporary injunction filed in the Special Civil Suit No. 1 of 2023 on merits. He agrees that the order dated 18 January 2023 passed on Application at Exh-28 in Special Civil Suit No. 1 of 2023 be set aside with consent without recording any reasons.
3) Mr. Kulkarni, the learned counsel appearing for the Petitioners has placed on record the details of accounts of the Defendants in which various amounts are lying. The statement is prepared on the basis of the information received from State Bank of India. In view of the statement made by Mr.Butala, the State Bank of India is being directed to convert the amounts lying in the above Bank accounts into fixed deposit receipts in the name of the respective account holders so that the amounts earn interest during pendency of the proceedings. 5) Accordingly with the consent of the parties, following order is passed:- (i) Order dated 18 January 2023 passed on Application at Exh-28 in Special Civil Suit No. 1 of 2023 is set aside. (ii) The Application for temporary injunction filed in Special Civil Suit No.1 of 2023 shall be decided by the Trial Court 6 of
Renuka 9-IA-10591-2024 on its own merits without being influenced by order dated 18 January 2023 passed in the Applications at Exh-9, 24 and 29 in Special Darkhast No. 101 of 2020.
(iii) The amounts lying in the Bank Accounts referred to in paragraph -3, shall not be withdrawn by the respective account holders and the Bank shall convert the amounts in those accounts into fix deposit receipts in the names of respective account holders.
(iv) The above arrangement of restraint order shall continue only in respect of the accounts enumerated in paragraph3 of the order and restrictions put by previous orders in respect of other accounts shall stand lifted. (v) The above arrangement shall be without prejudice to rights and contentions of both the parties.
6) With the above directions both, the Petition as well as the Appeal from Order are disposed of.
