P. C:- This Interim Application has been filed for setting aside the Order dated 12th July, 2022 passed by this Court, dismissing the First Appeal and for restoring the First Appeal to the file of this Court. The Interim Application also seeks condonation of delay of 1 year and 354 days in filing the present Interim Application. I have perused the Interim Application. In my view, sufficient cause has been shown by the Applicants/Appellants for condonation of S.R.JOSHI

14-ia-10747-2024.doc delay and for setting aside the Order dated 12th July, 2022 and restoring the First Appeal.

For this reason, the Interim Application is allowed in terms of prayer clauses (a) and (b) which read as under:- "(a) That the delay of 1 yrs, 354 days in filing the present Interim Application be condoned.

(b) That the order dated 12.07.2022 passed by the Hon'ble High Court order dt. 12.07.2022 dismissing the above First Appeal No.429 of 2002 be quashed and set aside and the aforesaid First Appeal No.429 of 2002 restored to the file of this Hon'ble Court."

Now, that the Appeal is restored to the file of this Court, the Appellants shall comply with the Order dated 12th July, 2022 and remove all other office objections, if any, within a period of four weeks from today. (FIRDOSH P. POONIWALLA,J.) S.R.JOSHI
