By the impugned order dated 15th December, 2021, the order passed under Section 32G as well as sale permission granted under Section 43 were set aside by the learned MRT and the matter was remanded to the Tahsildar and ALT for fresh adjudication as the legal heirs of the deceased Respondent No.1 to Respondent No.5 were not brought on record before the ALT.

Mr. Modak, learned counsel appearing for the Respondent Nos.6 and 7 submits that they are not the legal heirs of the Respondent Nos.1 to 5. Learned counsel appearing for the Intervenorsa_mandawgad 1 of

38 wp 9063-23.doc Applicant would submit that he is the legal heir of one of the coowners of the land and was not impleaded in the proceedings. 3.

As the arguing counsel is unavailable today, at the request of learned counsel for the Petitioner, stand over to 25th March, 2026, under the caption "part heard".
