Heard Mr. Agrawal, leaned Advocate for Applicants. He would submit that previous Court has heard these matters and opined that matters will have to be heard finally at the stage of admission. He would submit that exigency arises in the matters only because Respondent being a tenant whom he represented is facing trouble at the hands of Petitioner. He would submit that Petitioner has obtained a stay despite there being specific orders of this Court directing the
P3. CIVIL IA-11019-24.docx Competent Authority to fix the sale price in view of the declaration of Respondent as statutory tenant. He would submit that Respondent is third generation tenant in respect of the suit property even prior to tiller's day and therefore he is entitled to be a deemed purchaser. He would submit that after the stay was granted by this Court in the present group of Writ Petitions, Petitioner landlord has sold the property not once but twice which is added to the detriment of the tenant. By virtue of those sale proceedings, he has attempted to mutate the names in the revenue records. He would submit that situation and incident happened yesterday which has countered him to rush to this Court.

I have reasoned with Mr. Agrawal if the Petitioner is to be heard finally, it can only be done depending upon the roster of this Court. Considering the paucity of time, I am not willing to keep the matter for immediate hearing. Whichever Court seized with the matter will be apprised the situation faced by Mr. Agrawal and as per its convenience it may fix the matter for final hearing. This is the best I can do for Mr. Agrawal in view of the exigency mentioned by him. 4.
Praecipe is disposed.
