This application is taken out by the applicants, who are the original appellants, praying for substituted service on respondent nos.6, 9, 10 and

12. Since inspite of various efforts put in, these respondents could not be served.

I have heard the learned counsel for the applicants and Mr. Bhat, learned counsel for respondent no.3.

I have condoned the delay in filing the appeal. Inspite of various efforts made by the learned counsel for the appellants to serve civil application for condoning the delay on respondent nos.6, 9, 10 and 12, the same could not be served. Since I have condoned the delay, requirement of serving civil application for delay is dispensed with. However, still the appeal will have to be served and since inspite of best efforts, the civil application could not be served, to avoid any further delay, the prayer for substituted service of appeal on respondent nos.6, 9, 10 and 12 by paper publication is permitted.

The applicants are directed to publish a notice in one English paper i.e. 'Free Press Journal' and one Marathi paper i.e. 'Nav Shakti' which are in wide circulation in City of Mumbai.
