Even though, learned Advocate for the Original Claimants is ready to argue the matter, learned Advocate Mr.Kanojia for the Appellant - Insurance Company is not available. 2.

Though the accident occurred due to use of the vehicle - Auto Rickshaw, the driver of the Auto Rickshaw was charge sheeted not for an offence under Section 304-A of the Indian Penal Code, 1860 ("IPC") but under Section 304, IPC. This is one of the grounds for opposing the claim.
