This interim application is filed for condonation of delay of 189 days in filing restoration application and for restoration of Writ Petition (St.) No. 417 of 2022.

Learned counsel for the applicant submits that the applicant is a Municipal Corporation and there was no any intentional act on the part of the applicant in not removing office objections. He further submits that notices were not issued to the respondents in the original writ petition. 3.

Perusal of the application indicates that delay is not inordinate or deliberate. Respondents were not served in the original proceedings hence there is no impediment in entertaining this application in their absence.

For the reasons stated in the application, application is allowed in terms of prayer clauses (a) and (b).

Learned counsel for the applicant undertakes to remove office objections within a period of four weeks. If office objections are not removed within this time, petition shall dismiss without further reference to the Court.
