This is an Application seeking condonation of delay in filing of the captioned First Appeal.

A copy of the Interim Application has been served upon the Respondents. None appeared on behalf of the Respondents, though served. 3.

Having heard Learned Counsel for the Applicant and having perused the averments made in the Interim Application more particularly those set out in Paragraphs 5 and 6, I find that a case of sufficient cause has been made out. Even otherwise, I find that the delay is not inordinate and hence the same needs to be condoned.

Thus the Interim Application is allowed in terms of prayer clause (a), which reads thus;

This Hon'ble Court may by way any appropriate order/direction allow the present application of the Appellant and condone the delay of about 113 days in filing the accompanying appeal;"

The Interim Application thus disposed of accordingly. Interim Application No.11523 of 2024 6.

Learned Counsel for the Applicant today initially presses for stay of the operation of the impugned order. However, on a query from the Court, she informs that no steps have been taken in the execution.

Hence, in the event any steps taken in the execution, liberty to file an application for stay is granted.

In view of the above, the captioned Interim Application is disposed of with a liberty so granted.
