Learned Senior Advocate on behalf of the petitioner submitted that the tax receipts were material documents which this Court failed to consider. However, in my opinion, the consideration of tax receipts, in the context of factum of disqualification, cannot be termed as an error apparent on the face of the record, as it will be in the realm of appreciation of material. It is well settled that illegality in the order impugned necessarily leads to a finding of error apparent on the face of record. Hence, I do not find any error on the face of record.
