CORAM: BHARATI DANGRE & ASHWIN D. BHOBE, JJ.

DATED : 10th JANUARY, 2025 P.C:- 1.

Writ Petition (St) No.23314 of 2022 came to be dismissed, as on the objections being notified to be removed within the stipulated period, the same were not removed. 2.

Heard the learned counsel for the Applicant and perused the Application.

The Writ Petition is filed raising the challenge to the impugned order dated 13/05/2022 passed by Respondent No.2-Scrutiny Committee, thereby invalidating the tribe claim of the Petitioner.

2/2 16 IA-11752-24.odt On 16/02/2024, the Writ Petition alongwith the group matters was notified before the Registrar (Judicial-I) for removal of the office objections and two weeks time was granted to remove the objections. Inadvertently, as far as the Petitioner is concerned, the objections were not removed by his Advocate, which resulted in an order dated 04/03/2024, dismissing the Petition. It is only when the Petition was attempted to be tracked, the knowledge was gained about the conditional order being passed.

We are satisfied with the bonafides of the Applicant/Petitioner. As a result, Interim Application No.11752 of 2024 is made absolute in terms of prayer clause (b).

Writ Petition (St) No.23314 of 2022 is restored to its file. The Petitioner is directed to remove the office objections within a period of four weeks from today and the Petition is permitted to be circulated thereafter.
