There is a delay in setting aside the abatement. The delay is of 11 months and 18 days. Considering the reasons stated in the Application, the delay of 11 months and 18 days is condoned. 3.

The Application is allowed. The abatement is set aside. The learned counsel for the Petitioner No.1 is permitted to bring the legal heirs of Petitioner No. 2 on record.

Amendment be carried out within a period of two weeks. 5.
