This application is filed for condoning the delay in filing the present application and for restoration of the first appeal which came to be dismissed on 22 August 2019 for non-appearance. 2.
The delay in taking out the present application has been explained and same is condoned.

In the application, it is stated that during the period, when the matter was listed, the advocate had filed a leave note and further he had fallen sick and had to go to his native and thereafter the Pandemic started.

Being satisfied with the reasons stated in the application, the delay in taking out the present application is condoned and First Appeal
Sayyed 31-IA.11812.2024.doc (St) No.2339 of 2017 along with Civil Application No.2148 of 2017 is restored.

Mr. Singh, learned counsel for the appellant states that he has served the copy of the interim application and the appeal on the department. However, Mr. Singh is requested to serve the copies of interim application and appeal memo on Mr. Pandian, learned advocate appearing for the respondent.
