At the outset, learned Counsel for the applicant seeks leave to amend prayer clause (b) since the delay is not 189 days in filing the aforesaid appeal, but 229 days in filing the appeal. Leave granted. Amendment to be carried out forthwith during the course of the day. Wakodikar 1/2

Heard learned Counsel for the applicant as well as learned Counsel for the respondent.

Learned Counsel for the respondent opposes the delay condonation application. However, for the reasons set out in the application, we find that applicant has shown sufficient cause for condonation of delay.

Application is allowed and delay of 229 days caused in filing the aforesaid appeal, is condoned.

Application is accordingly disposed of.
