This Interim Application has been moved by the ApplicantInsurance Company seeking condonation of delay and extension of time in applying for refund of Court fees. 2.

The learned counsel for the Applicant submits that the Appeal filed by the Applicant/Appellant was withdrawn on 18th January, 2021. While withdrawing the Appeal, the statutory amount deposited by the Insurance Company was transferred to the MACT with liberty to the Appellant to withdraw the same. It was further observed that the Court fee be refunded as per rules. Rushikesh

It is submitted by the Applicant that after the disposal of the Appeal, they could not take timely steps for refund of Court fee and they approached the Decree Department after the stipulated time had expired. However, the application was not entertained since it was beyond the prescribed time. The Applicant is seeking extension of time for refund of the Court fee, no prejudice would be caused to the Respondent if such extension is granted. There is a delay of 945 days in applying for refund of Court fee.

For the reasons stated in the Application and in the interest of justice, the Interim Application is allowed. The delay of 945 days in applying for refund of Court fees is hereby condoned. The time for refund of Court fee is extended by six weeks from today. 5.

The Interim Application is disposed of.
