Interim Application has been preferred to set aside the abatement of the Appeal against deceased Respondent No. 7 and recall of the order dated 26th March, 2024.

Mr. Patil, learned AGP submits that the conditional order came to be passed as the proceeding abated against deceased Respondent No. 7 and no steps were taken for bringing on record the legal heirs on record. He further submits that the Interim Application has been taken out and therefore, the order of abatement be recalled. 3.

As appropriate steps have been taken by the State for bringing on record the legal heir of deceased Respondent No. 7, the Interim Application is allowed in terms of prayer clause (b), (c) and (d).
