Writ Petition No.12764 of 2023 is filed challenging the correctness of the order dated 6th August 2022 passed in Civil Misc. Application No.6 of 2013. That Misc. Application was filed by the Defendants for restoration of their Appeal which was dismissed for default. That Misc. Civil Application was dismissed on 6th August 2022. Whereas, as per the order dated 21st July 2022, the Appellate Court disallowed the Applicants / Defendants / Appellants to bring the LRs of deceased Bhimabai on record.

Some of the Respondents are served. Learned Advocate for Respondent Nos.1 to 3 agrees to appear if he is served of the Writ Petition. Let, he be served with copy of Writ Petition. The Petitioner may verify whether all the parties are served or not and if not served, take steps against those Respondents whose presence is required. 6.
