The delay is huge delay. The Applicant is the owner of the offending motorcycle. He has to give chance to put his side. Considering this fact, the delay of 2 years and 117 days is condoned for filing the appeal, subject to payment of cost of Rs.5,000/-. 5.
The Applicant is directed to pay cost of Rs.5,000/- to the J.J. Hospital, Mumbai within a period of four weeks. 6.
The application is allowed and disposed off.
