Heard learned Advocate for the applicant-wife. 2.

Misc. Civil Application No.152/2023 was dismissed for nonprosecution as per the order dated 24 April 2024. When that application was pending, there was an attempt to settle the dispute through mediation. The learned Senior Advocate Shri Rajiv Patil was also appointed as Mediator but it has not achieved desired results. 3.

There is a divorce proceeding filed by the husband before Family Court, Alibag. Applicant-wife wants transfer of the same to the Civil Judge Senior Division at Panvel. The petition at Alibag is fixed for filing of written-statement. She is at liberty to make

LSP 2 15 ia 13992.24.doc necessary application before the Family Court, Alibag. She can also mention about filing of transfer application. The concerned Court to consider her request positively.

It is submitted that there was some communication gap in between the applicant and her Advocate That is why she could not consider her appearance in a transfer application. I have seen the earlier orders.

For the reasons stated in the application, it is restored. Application is allowed in terms of prayer clause (ii). It is disposed of. Misc. Civil Application No. 152 of 2023 6.

Issue notice, returnable on 7 February 2025.
