This application is filed by the original appellant for withdrawal of 25% of the amount, pending final disposal of the appeal. Pursuant to the Tribunal's order, the Insurance Company has deposited Rs. 54,26,761/-. Rs.15,00,000/- was withdrawn pursuant to the order of this Court on 22nd July, 2022.

I have heard learned counsel for the applicants and the Insurance Company. The applicants are senior citizens and were dependent on the deceased. The appeal is still not admitted, though filed in the year 2019. Therefore, for the reasons stated in the civil application, since the appeal

HMK 15. IA-14092-2024.doc will take some time for hearing, it would be in the interest of justice that applicants be permitted to withdraw Rs.10,00,000/-, which will be subject to the outcome of the appeal.
