Interim Application has been preferred seeking stay of the Judgment and Award dated 27th September, 2023 passed by the Reference Court in LAR No.40 of 2014. Mr.Chawan, learned Senior Advocate appearing for the Applicant submits that there has been an enhancement from the original Award of Rs.135 per sqr.mtrs. to 800 per sqr.mtrs. He would further submit that the Reference Court has failed to consider that sum of Rs.33,57,774/- had already been paid to the original claimants which is not reflected in the impugned judgment dated 27th September, 2023. He would further submit that the distress warrant has already been issued and seeks stay.

Considering that part of the amount is stated to have been paid to the original claimants, which does not find mention in the order dated 27th September, 2023 and the willingness is shown to deposit the balance amount, pending hearing of the present Appeal, ad-interim relief in terms of prayer Clause (a) is granted till the next date subject to deposit of the balance amount after deducting the amount already stated to have been paid to the Claimants within a period of three weeks from today. 3.
List the Appeal on 6th December, 2024.
