The Petitioner submits that after filing of the Petition, she has been selected and appointed as a Talathi. Since her claim of belonging to the 'Thakar Scheduled Tribe' category has been invalidated, she is likely to be terminated.

Since the Petitioner/Applicant prays for protection as against her termination, since she has recently joined as a Talathi on probation and her claim has been invalidated, we direct the Applicant/

Trupti 2 16-ia14557-2024.odt Petitioner to tender an affidavit undertaking in this Court, on or before 21st January, 2025 and copy be supplied to the employer within the same timeline, stating therein that she would continue to be on probation and would not seek regularization or increments or promotion or service benefits etc., until her claim is validated by this Court. 3.

On the condition of filing such affidavit undertaking, we direct the employer not to terminate the service of the Petitioner, only because her claim has been invalidated. The issue as regards her confirmation in service after successful completion of the probation, would be subject to a further order of this Court, if such a request is made to this Court.
