Learned Counsel for the Applicants undertakes to serve Respondents and file an Affidavit of Service. The present Application is filed for bringing the legal heirs of Respondent No.3 on record. 2.

Having due regard to the submission made as also fact that none appeared to oppose the Application and the formal nature of the Application, the same is allowed in terms of prayer clauses (a), (b) and (c) which read thus:- Shubham 1/2

(b) This Hon'ble Court may be pleased to set aside the abetment of first appeal in respect of the Respondent no.3;

(c) that this Hon'ble court may be pleased to permit the Applicant to delete the name of Respondent no.3 and the proposed Respondents 3/1. Jagruti Rajendra Thakur, 3/2. Rohit Rajendra Thakur and 3/3. Jignyasa Rajendra Thakur, be brought on as Respondent Nos.3/1 and 3/3 and be permitted to carry out the consequential amendments if any;" 3.

Amendments to be carried out within a period of two weeks from today.
