Interim Application No.14782 of 2024 seek condonation of delay of 111 days in filing the Family Court Appeal being aggrieved by the impugned Judgment dated 4th April 2024 passed by the Family Court, Mumbai at Bandra in Petition No. A-1845 of 2021, thereby dismissing the petition filed by her seeking dissolution of the marriage N. S. Chitnis 1/2

15-ia.14782.2024.doc on the ground of cruelty.

Perused the application and on hearing the learned counsel for the applicant, we find the explanation offered for the delay to be bonafide and in the wake of the sufficiency of the cause being shown, we condone the delay.

Interim Application is made absolute in terms of prayer clause 'a'.

The registry is directed to register the Family Court Appeal.

Appeal is Admitted. The respondent shall be served a notice informing that the appeal has been admitted. Call for R&P. Learned counsel for the appellant is also at liberty to prepare a private paper-book and file it in the registry within a period of 12 weeks.
