1. By this Interim Application, a prayer is made that the delay in filing the aforesaid First Appeal, stated to be of 136 days, be condoned. 2.

We have perused the averments as made in the Interim Application which is a detailed application setting out several reasons. Learned Counsel for the respondent has also taken a fair stand. 3.

In this view of the matter, we are inclined to accept the contention as urged to condone the delay in favour of the present appeal, subject to payment of cost of Rs.10,000/- (Rupees Ten Thousands only) to the respondent.
