The Applicant seeks withdrawal of the amount deposited by the Respondent-State, which is stated to be due and payable to him towards arrears of salary. This Court, vide order dated 2nd May 2024, had observed in paragraph Nos.4 & 5 thereof as under:- osk 1 of

We note that the Divisional Deputy Commissioner has sought an approval from the State Government as regards the payment of Rs. 34,95,788/- to the Petitioner towards arrears of salary. We note that the proposal is submitted in March 2024. 5.

Stand over to 10 July 2024. If no response is received from the State Government to the proposal of the Divisional Deputy Commissioner regarding the payment of amount of Rs. 34,95,788/-, the Court may direct the Respondent - State to deposit the said amount in the Registry of this Court subject to further orders."

Thereafter, this Court passed an order dated 10th July 2024 with observation that the learned A.G.P. had made a statement that the amount would be deposited within three weeks. In deference to the said statement, the amount has now been deposited with this Court. 3.

Admittedly, the Petitioner is in service and the amount deposited appears to be due to him towards arrears of salary. 4.

We therefore permit the Petitioner to withdraw the said amount along with the interest accrued thereon, upon furnishing the usual undertaking, subject to the outcome of this Writ Petition. 5.
