2) Hence, since the parties are willing to settle the First Appeal amicably, for the reasons stated in the Application, the delay in preferring the First Appeal is condoned. 1/2

4) Ms. Rema Subramaniam, Manager, the Oriental Insurance Co. Ltd. is present in Court. Learned counsel for the Appellant identified her. There is a compromise between the parties. Consent Terms are produced on record. It is signed by all the parties. Consent Terms are taken on record and marked 'X' for identification. Undertakings given in the Consent Terms are accepted. The Appellant seeks leave to withdraw the Appeal in view of the Consent Terms.
5) Accordingly, the First Appeal is disposed of as withdrawn in terms of Consent Terms.
6) In view of disposal of First Appeal, Interim Application pending therein shall also stand disposed of. 7) Court Fee be refunded as per the Rules.
8) Statutory Deposit shall be transferred to the concerned Tribunal.
9) Record and Proceedings be sent back to the concerned Tribunal forthwith.
