Manoj 8-IA-15230-2024.doc 3) Mr. Kanojia, the learned Advocate for the Applicant states that, the Applicant has no statutory defence in this case. In view thereof, the notice to Respondent No.2 i.e. owner of the offending vehicle be dispensed with.

4) Mr. Chavan, the learned Advocate waives notice on behalf of the Respondent No.1.

5) In view thereof, the notice to Respondent No.2 is dispensed with.

6) Considering the reasons stated in the Application, the delay of 63 days in filing the Appeal is condoned.

7) Appeal be registered forthwith.

8) Application stands disposed of.

Learned Advocate for the respective parties state that Appeal itself be taken up for final hearing and they undertake to submit the Compilation of Documents.
