Present Application seeks condonation of 1 year and 75 days delay in filing aforesaid Appeal. Respondent Nos.2, 3 and 5 are duly served, however, they have not filed their appearance. 2) Heard learned Advocate for the Applicant and Respondent Nos.1 and 4. Perused the Application.

3) Mr.Ghadge, the learned Advocate submitted that the Applicant could not file the Appeal in time due to old age and financial difficulty. For this and other reasons stated in the Application, the delay of 1 year and 75 days is condoned.

4) Appeal be registered forthwith.

In addition to the Court's notice the Appellant to serve the Respondent Nos.2, 3 and 5 with private notice and file the affidavit of service before the returnable date. Hamdast allowed.
